Welcome to the website operated by Superior Diesel & Automotive Performance LLC (“SDA Performance,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the website located at https://superiordieseloffroadlv.com (the “Site”) and any services, content, or features made available through the Site.
By accessing or using the Site, requesting a quote, scheduling service, or otherwise interacting with us through this Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.
1. About SDA Performance
Superior Diesel & Automotive Performance LLC is a diesel truck repair, fleet maintenance, off-road customization, and performance upgrade shop located at 2722 Abels Ln, Las Vegas, NV 89115. Our services include, but are not limited to, diesel engine repair and diagnostics, transmission service, fleet maintenance, performance tuning, turbo and injector work, lift kits, suspension upgrades, wheel and tire packages, and other off-road and performance modifications.
The Site is informational and intended to allow visitors to learn about our services, request quotes, schedule appointments, contact us, and apply for employment. The Site does not facilitate online sales or e-commerce transactions.
2. Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract to use this Site or to request services from us. By using the Site, you represent and warrant that you meet these requirements. If you are using the Site on behalf of a business or fleet, you represent that you are authorized to act on behalf of that entity.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Legal compliance: Use the Site in any way that violates any applicable federal, state, local, or international law or regulation;
- Accuracy: Submit false, misleading, or inaccurate information through any form, including quote requests, contact forms, or job applications;
- Spam: Use the Site to transmit any unsolicited commercial communications, spam, or advertisements;
- Security: Attempt to gain unauthorized access to any portion of the Site, our servers, or any connected systems;
- Malicious code: Introduce viruses, malware, trojans, or any other harmful code;

4. Quote Requests, Estimates, and Service Appointments
a. Quotes Are Non-Binding
Any quote, estimate, or pricing information provided through the Site, by phone, by email, or in person is a preliminary estimate only. Final pricing is determined after physical inspection of your vehicle and may vary based on actual condition, parts availability, manufacturer pricing, labor required, and any additional issues discovered during diagnosis or repair.
b. Authorization to Inspect and Diagnose
By dropping off a vehicle for service, you authorize SDA Performance to perform a reasonable inspection and diagnosis necessary to provide an accurate estimate. You will be contacted before any repairs exceeding the originally authorized scope are performed.
c. Parts and Availability
Parts pricing and availability are subject to change based on supplier pricing, market conditions, supply chain factors, and manufacturer stock. We reserve the right to substitute equivalent or upgraded parts when an originally specified part is unavailable, with your prior consent for any material change.
d. Appointment Scheduling
Submitting a quote request, contact form, or appointment request through the Site does not constitute a confirmed appointment. All appointments must be confirmed by SDA Performance staff by phone or email. We reserve the right to reschedule appointments due to capacity, parts delays, or other operational factors.
5. Vehicle Drop-Off, Repairs, and Pickup
a. Authorization for Repairs
All repair work requires written or verbal authorization from the vehicle’s owner or the owner’s authorized representative. Authorization may be obtained in person, by phone (with documentation), by email, or through a signed work order.
b. Storage and Abandoned Vehicles
Vehicles left at our facility for more than fifteen (15) days after notification that work is complete and ready for pickup may be subject to daily storage fees. Vehicles abandoned for extended periods may be subject to mechanic’s lien and disposition under applicable Nevada law, including Nevada Revised Statutes governing repair shop liens.
c. Personal Property
SDA Performance is not responsible for personal items left in vehicles. Please remove valuables, electronics, firearms, and any items of sentimental or financial value before dropping off your vehicle.
d. Test Drives and Road Testing
By authorizing repair work, you also authorize SDA Performance technicians to perform reasonable road tests of the vehicle to diagnose issues, verify repairs, and ensure proper function before returning the vehicle to you.
6. Warranties and Limitations
a. Workmanship Warranty
SDA Performance stands behind the quality of our workmanship. Specific warranty terms for labor and parts are provided on your work order or invoice at the time of service. Warranty coverage varies based on the type of work, parts installed, and manufacturer warranties from third-party parts suppliers.
b. Performance and Modified Vehicles
Vehicles that have been modified for performance or off-road use, including but not limited to engine tuning, lift kits, oversized tires, turbo upgrades, transmission modifications, exhaust modifications, or any aftermarket components, may experience reduced longevity of certain components, may not be street-legal in all jurisdictions, and may void portions of the manufacturer’s original warranty. You acknowledge and accept these risks when authorizing performance or off-road modifications.
c. Emissions and Compliance
Certain modifications, including but not limited to exhaust system modifications, EGR-related work, DPF-related work, and ECU/ECM tuning, may not be permitted for use on public roads in Nevada or other jurisdictions and may violate federal Clean Air Act regulations. You are solely responsible for ensuring that any modifications performed on your vehicle comply with applicable federal, state, and local laws, and for any consequences arising from non-compliant use of a modified vehicle.
d. No Implied Warranties
EXCEPT FOR THE EXPRESS WRITTEN WARRANTIES PROVIDED ON YOUR WORK ORDER OR INVOICE, SDA PERFORMANCE MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
7. Payment Terms
Payment is due in full upon completion of service and before vehicle release, unless other arrangements have been made in writing in advance (including approved fleet account terms). We accept payment methods as posted at our facility. Returned checks, declined cards, or unpaid invoices may incur additional fees and interest at the maximum rate permitted by Nevada law, and may result in a mechanic’s lien being placed on the vehicle.
8. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, photographs, images, videos, service descriptions, page layouts, and any software or code, is the property of SDA Performance or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may view, download, and print content from the Site solely for your own personal, non-commercial reference (for example, to evaluate our services or share our contact information). You may not reproduce, modify, distribute, publicly display, sell, or create derivative works from any content on the Site without our prior written consent.
“Superior Diesel & Automotive Performance,” “SDA Performance,” the SDA logo, and any related names and marks are trademarks of Superior Diesel & Automotive Performance LLC. All other trademarks, brand names, and product names referenced on the Site (including names of vehicle manufacturers, parts brands, and tire and wheel manufacturers) are the property of their respective owners and are used for identification and reference purposes only.
9. User Submissions
If you submit information to us through the Site — including quote details, vehicle information, photos, customer reviews, comments, or job application materials — you grant SDA Performance a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and display that information for the purpose of responding to your inquiry, providing services, processing employment applications, and operating our business.
You represent and warrant that any information you submit is accurate, that you have the right to submit it, and that it does not infringe the rights of any third party. We are not obligated to publish or use any submission and may remove submissions at our discretion.

11. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SDA PERFORMANCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that the Site will be available at all times, free of viruses or harmful components, or that any defects will be corrected. You assume the entire risk of using the Site.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SDA PERFORMANCE, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY INFORMATION OBTAINED FROM THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total cumulative liability arising out of or relating to your use of the Site shall not exceed one hundred U.S. dollars ($100.00) or the amount you paid us for services giving rise to the claim, whichever is greater. Liability arising from physical repair work performed on your vehicle is governed separately by your work order or invoice and applicable Nevada law, not by these Terms.
13. Indemnification
You agree to indemnify, defend, and hold harmless SDA Performance, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Site; (c) your violation of any law or the rights of any third party; or (d) any inaccurate or false information you submit through the Site.
14. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. When we make changes, we will revise the “Effective Date” at the top of this document and post the updated Terms on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
16. Severability and Waiver
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any work orders, invoices, or written agreements between you and SDA Performance, constitute the entire agreement between you and SDA Performance regarding your use of the Site, and supersede all prior or contemporaneous communications and agreements regarding the same subject matter.
